Terms of Service

These Terms govern your access to and use of Boloky's browser extension, web dashboard, and supporting services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

These Terms aren't a substitute for legal advice. They describe how we expect the Service to be used and what we will do if it is used in ways that put us, our infrastructure providers, or other users at risk.

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

You may not upload, dispatch, or otherwise transmit through the Service any content or behavior described below. We'll suspend or terminate accounts that violate this policy, and we may remove the offending content immediately and without prior notice.

Prohibited content

• Sexually explicit or pornographic material, sexually suggestive content involving minors, or content that sexualizes anyone under 18.
• Content that infringes copyright, trademark, publicity, privacy, or any other right of a third party — including clips you don't own and haven't licensed.
• Content that incites violence, harassment, or hatred against individuals or groups based on protected characteristics; threats; doxxing; non-consensual intimate imagery.
• Content that promotes self-harm, terrorism, or violent extremism.
• Malware, phishing, scams, deceptive deepfakes, or content designed to mislead viewers about the identity or statements of a real person without clear disclosure.
• Content that violates the acceptable-use policies of our infrastructure providers (including but not limited to the video host that processes uploads on our behalf).

Prohibited behavior

• Dispatching content onto channels you don't own or haven't been authorized to operate on.
• Reverse engineering, scraping, automating, or otherwise abusing the Service in ways that disrupt other users or circumvent rate limits and quotas.
• Using the Service to send unsolicited bulk content, spam, or to harass other users.
• Sharing your account credentials, transferring your account, or letting unauthorized parties use it.

You keep ownership of everything you upload. By uploading or dispatching content, you grant Boloky a worldwide, non-exclusive, royalty-free license to host, process, transcode, deliver, and display that content solely for the purpose of operating the Service for you and your viewers. The license ends when you delete the content, except for copies our infrastructure providers may retain for a short time to complete in-flight processing.

You represent and warrant that you own or have all necessary rights to upload, dispatch, and license the content as described above, and that doing so doesn't violate any law, contract, or third-party right.

We don't pre-screen user content. We may, but aren't obligated to, review, remove, or restrict access to content that we reasonably believe violates these Terms.

Boloky respects intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to contact@boloky.com including:

1. Identification of the copyrighted work you claim has been infringed.
2. A link or other specific identifier to the allegedly infringing content on the Service.
3. Your contact information (name, email, phone, mailing address).
4. A statement that you have a good-faith belief that the use isn't authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
6. Your physical or electronic signature.

We will respond to valid notices by removing or disabling access to the disputed content and notifying the affected user. Repeat infringers will have their accounts terminated. Counter-notifications follow the standard DMCA process; reach out to the same address.

Some channels may require explicit authorization before you can dispatch content onto their videos. Authorization can be established by signing into a Google account that owns or manages the YouTube channel, or by being granted access by a Boloky administrator at the request of the channel owner. Attempting to bypass these checks is a violation of these Terms.

You're responsible for keeping your account credentials secure. Notify us at contact@boloky.com if you suspect unauthorized use.

We may suspend or terminate your account at any time if we believe you've violated these Terms, if required by law, or to protect the Service and other users. Where practical, we'll explain the reason and give you a chance to respond. You can stop using the Service and delete your account at any time from the dashboard.

We work to keep the Service available, but we don't guarantee uninterrupted operation. Maintenance, infrastructure outages, or third-party provider incidents may cause downtime. Features may be added, changed, or removed.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability — to the maximum extent permitted by law.

To the maximum extent permitted by law, Boloky and its affiliates aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising out of or related to the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) one hundred US dollars.

You agree to defend, indemnify, and hold Boloky and its officers, employees, and agents harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (i) content you upload or dispatch through the Service, (ii) your use of the Service, or (iii) your violation of these Terms or any law or third-party right.

We may update these Terms from time to time. When we make a material change, we'll update the "Last updated" date above and, when reasonable, notify you in-product or by email. Continued use of the Service after a change means you accept the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Boloky is established, without regard to its conflict of laws principles. Any dispute relating to the Service or these Terms will be resolved in the courts of that jurisdiction, except where mandatory consumer-protection law requires otherwise.
